      Out-of-control fraud guidelines

A little more than a year ago, Sholom Rubashkin, a 51-year-old father of 10 with deep roots in his Iowa community and no prior criminal record, was sentenced to serve 27 years in prison following his conviction on financial fraud charges. Remarkably, that sentence looks lenient compared to the sentence prosecutors originally urged: life without parole. The attention garnered...Continue Reading »

    Case Status

On January 3, 2011, Sholom filed an appeal with the 8th Circuit Court of Appeals in St. Louis. Following the filing of this appeal, prominent legal organizations filed amicus briefs supporting the appeal for new trial.

In a rare move, the government resisted to the filing of the briefs. Shortly following a law review published in Bloomberg Law Reports, the government withdrew their opposition.

On March 11, 2011 the government filed their reply to Sholom's appeal brief. His reply was filed on April 18, 2011. Oral arguments were presented to the 8th Circuit Court of Appeals on June 15th.

At that hearing Nat Lewin informed the court that a motion for bail pending appeal would be filed. It was filed on June 16, 2011, and was denied.

To date, over 45 Congressmen have written to Attorney General Eric Holder to investigate this case.

On September 16, 2011, the Court of Appeals in the 8th Circuit denied Sholom Rubashin's appeal. But the fight for justice is still on.
